Packet A offers will be used to evaluate the technical feasibility of the contractor. Basing on the Packet A offer, the short listing will be done. The Packet B offers of the short-listed tenders only will be examined, which contains the financial offer of the contract. The tenderers should submit Packet A and Packet B forms in separate sealed covers. Each tender form under Packet B should contain the following: The percentage of commission that will be paid to the Railways on the commission received by the contractor. The minimum should not be less than 10% of the commission payable to him and the maximum will not be quoted more than 100%. If any tenderer quotes more than 100% commission, the tender will be treated as invalid. In this, the contractor should quote only the percentage over and above 10%. The land licence fee payable to the Railways, the minimum will be 20% of the cost of the land as per market value. The amount equivalent to 20% is Rs.___________________. If there is more than one candidate offering same highest bid, there will be a draw of lots to be done by a child for allotment of the stall. Tenders submitted without proper and fully complying with the tender requirements will be disqualified and will not be considered. The contractor shall be responsible to indemnify the Railway Administration in case of any damages claimed for any injury or whatsoever sustained by any third party or railway personal of any act of omission or commission by the contractor or his agents or found vicariously liable to compensate by any authority or court of law. The amount as falling due on such claims or as per agreement clause may be lawfully recoverable from his security deposit. The contractor should subject the employees under the contract to insurance scheme. The contractor shall not interfere with the communication or any other installations of the Railway Administration without prior written consent of the Railway Administration. The Railway Administration shall not be responsible or liable to pay any compensation or refund any portion of the rental charges to the contractor for reasons whatsoever. The contractor shall not assign, sublet or transfer the contract in full or in part. If it is found that the contractor has sublet either in full or in part the Railway Administration will terminate the contract with a notice period of 30 days duly forfeiting the security deposit and confiscating the equipment. The contractor shall be responsible to indemnify the Railway Administration for any claim by any person for the provisions of various acts enacted by the Central/State Governments, such as payment of wages act, workmens compensation act, hours of employment regulation act, employment of children acts etc. The contractor shall be liable to pay fine upto a sum of Rs._____________ (Rupees ______________________ only) at the discretion of the Railway Administration for each misconduct or breach of provisions of this agreement on the part of the contractor or any of his/her agents, servants, workmen to observe or perform any of the terms and conditions of the agreement. The Railway Administration shall not be responsible for any loss/damages to any financial agencies, commercial outfits consequent on the termination of the contractor for whatsoever reasons. In the event of the death of the contractor during the contract period, the legal heirs of the deceased viz., wife, son, daughter, widow dependent, daughter-in-law may be allowed to continue the unexpired portion of the contract purely at the discretion and permission of the Railway Administration on production of legal heir certificate subject to fulfilling the terms and conditions stipulated in the agreement. The agreement shall at all times be open to revision and amendment by the Railway Administration after giving one months notice in writing of such revision or amendment at the end of which time any revision or amendment shall take effect, unless the contractor has objected there to in writing giving 15 days after the receipt of said notice. If any dispute difference or question shall arise between the Railway Administration hereto or has to the constructions or interpretations of any of the terms and conditions as to its applications (except the decisions whereof here in expressly and the contractor as to the respective rights and duties and obligations of the parties provided for) then the same shall be referred to the sole arbitrator appointed by the Chief Commercial Manager, South Central Railway, Secunderabad whose decision shall be final and binding on the contractor. Subject as otherwise provided in this agreement all notices to be given on behalf of the President of India and all other actions to be taken on his behalf may be given or taken on his behalf by the Divisional Railway Manager (Commercial), _______________ division, South Central Railway, ______ (place). The electrical connection will be provided to the successful tenderer by applying through the Sr.Section Engineer of the concerned station. The successful tenderer shall have to arrange at his own cost all the equipments, wiring and other electrical installation necessary as per the required standard and specification of the Railway Administration. Apart from the above said charges, successful tenderer must remit approximately one year electrical energy consumption charges as caution deposit besides remitting the electrical energy charges as and when claimed. Necessary connection charges as advised by the Railway Administration has also to be paid. The Railway Administration does not guarantee for the adequate number of customers in relation to the licence fee offered by the tenderer. If the successful tenderer fails to pay licence fee and other charges due to Railway Administration within the stipulated time, he/she is liable to pay liquidated damages at the rate of 18% per annum or part thereof to be reckoned from the due date to the actual date of payment. The successful tenderer will have to erect the necessary structures/glow lit signboards for his/her STD/PCO booth. Railway Administration will give the sketch giving the details of structure to be erected including the colour combination of the stall and glow-sign boards. Separate glow-sign boards as per the specifications of Railway Administration should be erected near the booth to indicate the availability of the booth. The successful tenderer shall comply with the requirements of health standards and if the person(s) employed by the successful tenderer is found suffering from any infectious diseases as detected by Railway Administration, the person(s) will not be allowed to perform duties till recovery of the disease as a precautionary and preventive measure. The STD/PCO booth design and material used for construction should have the approval of the Railway Administration. The cost of the structures including erection, lighting to be borne by the tenderer. The successful tenderer has to bear any tax that may be levied by the Government, which are in force. The successful tenderer shall not store or bring or keep in the premises heavy articles so as to injure or damage the premises or keep goods of combustible or inflammable nature. The successful tenderer shall not use electrical heater, toast and other appliance in the premises for preparation of tea, coffee or heating of food etc. The renewal of the contract for another term depends on the quality of service and regular payments of the dues to the Railway Administration. The successful tenderer should provide laminated photo identity cards to the persons employed by him/her for running the STD/PCO booth, counter signed by Station Superintendent or any other Officer authorised by Railway Administration. The successful tenderer should keep all the relevant records such as allotment letter, all payment details paid to the Railways also of the BSNL/other parties in the booth. The size of the PCO booth will be of 5 x 6 (five feet x six feet). Two telephones will be permitted in one PCO booth. Only one booth will be allotted to one person. The contractor should have authorised telephones at the booth. Under no circumstances, unauthorised telephones will be allowed. If the Railway Administration finds any such unauthorised telephones, the contract will be terminated forthwith. One additional telephone (apart from two) will be permitted if the contractor wishes to have a FAX facility in the PCO booth. No extra/additional space will be provided for this FAX facility. The contractor will also be permitted to install the Internet facility at the booth, for which, 10% additional space will be given, if possible, on collection of proportionate ground rent. Indent about this should be indicated in the application along with enhanced bid for licence fee. The period of contract will be for five years initially and can be renewed for another term of five years. Licence will be for a period of 10 years only including extension period. The booth operator has to submit the original bills issued by MTNL/BSNL/Local DOT/other authorised service provider to work out the commission payable to Railways, every month. The PCO booth should be constructed/erected at the cost of the contractor. Yellow colour with black border should be used for PCO booth for easy identification. A glow-sign board as per the specifications given by the Railway Administration should be erected. Financial aspects: The contractor should have the financial resources to pay the necessary BSNL/private agencies charges for getting the connection as well as constructing/installing a booth on the Railway premises and capacity to pay Railway licence fee and also for employing some staff to man the booth. The documentary evidence should be submitted for movable and immovable property on the contractors name with ownership of not less than one year. In case of Bank deposit, necessary documentary evidence giving details of opening date of the account (the bank account should be of one year old), transactions details and deposit level maintained. The contractor should pay the ground rent for area occupied at the rate of minimum 20% of the land cost calculated as per the market value. This ground rent will be for the first year and for subsequent years 10% escalation will be added over the previous year. The contractor should pay commission to Railway Administration over the commission he/she receives from the BSNL/private agencies. For this minimum commission is 10% over the commission received and the contractor should pay the percentage (which will not be less than 10%) offered as per the Packet B offer. The commission is as per telephone; the percentage offered in the tender form will be applicable to the number of telephones available at the booth. At the time of taking over the contract, the contractor should pay one year ground rent and security deposit. The contractor should also pay cess charges @ Rs.42/- per month. The electrical connection charges and advance consumption charges as billed by the Railway Administration. The Railway Administration does not guarantee for the adequate number of customers in relation to the licence fee offered by the tenderer. The work should be completed and the STD/PCO booth be commissioned within 30 days from the date of signing of the letter of acceptance. The successful tenderer has to bear any tax that may be levied by the Government/local bodies, which are in force. The renewal of the contract for another term depends on the quality of service and regular payments of the dues to the Railway Administration. In the case of extension/renewal is awarded to the contractor, the land licence fee will be fixed afresh by obtaining fresh land value certificates or 10% of the escalated ground rent whichever is higher.
