The amount of the tender should be legibly written in ink in figures and in words. In case of difference between the figures and words, the amount quoted in words only will be considered. 8. The validity of the tender submitted should be for 90 days from the date of opening of Tenders. 9. The sealed tenders (with superscription containing the name of the contract and the station for which the tender is being submitted) shall be dropped in the Tender box kept in the office of the Senior Divisional Commercial Manager, ___________ division, South Central Railway, ________ (place) on __________ from ______ hrs to _________ hrs. 10. The Railway Administration reserves to itself, the right to reject all or any of the tenders without assigning any reasons thereof and also the contract can be awarded for a lesser period instead of five years. 12. The successful tenderer shall remit an amount equivalent to 1/5th of the bid amount towards licence fee in first year. He/she is also required to pay an amount equivalent to one year’s licence fee towards Security Deposit. 13. In the event of the successful tenderer fails to remit the licence fee and also to execute an Agreement in the prescribed form and take up the work within 7 days from the date of receipt of the letter of acceptance, the contract will be cancelled duly forfeiting the EMD. 14. The “Terms and Conditions” supplied along with the tender form and the clauses listed in the model Agreement will be binding on both the parties. The tenderer should afffix his signature on each page of Tender Schedule including “Tender Form”, “Tender Schedule”, “Terms & Conditions” and “Model Agreement”. 15. Any letter, notice, communication sent by the Railway Administration to the Tenderer/Licensee to his address given in the tender, through registered post or courier service will be deemed as served even though the same is returned undelivered. The standards and specifications for the maintenance of the Toilets procedure are indicated hereunder: All cubicles should be provided with sufficient buckets and mugs. Bathrooms, Toilets, Urinals should be cleaned thoroughly using bleaching powder, detergents, cleaning materials and branded liquids like Harpic etc. Acid should not be used at all. Necessary deodorant/disinfectants should be used. After every use, bathrooms and urinals should be washed and there should be no room for unpleasant smell. Pay & Use Toilets should be kept scrupulously cleaned by removing cobweb and the floors washed frequently and kept in dry condition by mopping the area. Naphthalene balls, room refreshers/deodorant should be liberally used. The following items should be kept in cupboard and the list of items is to be pasted inside the cupboard: Soap mop (attached to a string or stick). Water pusher Brooms – two Brush for cleaning toilet seats and wash basins. Choke removers (for wash basins and toilets seats). Foot mats Stainless steel bucket for bathroom Stainless steel mugs for all toilets and bathrooms. Foot operated dust bin (for all ladies toilets) Dust bin Hand sprayer Deodorants (Jelly or aromatic compound) Disinfectants (Phenyle) Harpic (for cleaning floors, tiles, sinks, removing stains) Cleaning powder, soda ash Naphthalene balls, room refreshner cakes (branded items) Insecticides (branded item) Bleaching powder Hydrochloric acid (cleaning closets) 7. A board clearly indicating the charges mentioned above with the name of the Licensee and the period of contract shall be exhibited at the entrance of Pay & Use Toilets, at the cost of the contractor with letters in bold capitals. 8. Tokens for Urinals/Toilets/Bathing should be printed with serial number and the licensee should collect only the prescribed fee. 9. If over-charged, the contractor will be penalised and the contract may also be terminated. 10. There would be fines for bad quality of service/behaviour or unhygienic conditions. 11. Sub-standard maintenance will force the Railway administration to impose fine/cancellation of the contract. 12. The attendant who is manning the toilets must be in uniform with identity card with a photo, issued by the contractor and countersigned by the Station Manager concerned. 13. A complaint register should be made available to the passengers/users of the toilets to record their complaints. 14. It should be ensured that separate sections are provided in the Toilet complex for the use of Gents and Ladies. 15. Indication boards to be displayed prohibiting smoking in the complex. 16. The licensee shall be held responsible for the loss incurred by the Railway Administration and damages caused to the property/premises handed over to him, during the period of contract and he shall reimburse the cost of rectification/ repairs works to the Railways. 17. The Railway Administration will provide water and electricity and the charges for the same have to be paid by the licensee. GENERAL: 1. In the event of any adjustment made by the Railway Administration from the Security Deposit, the licensee shall reimburse and recoup the same amount within 14(fourteen) days from the date of communication of such adjustment. 2. The licensee shall comply with the provision of Employment of Child Labour Act, Minimum Wages Act and Workmen’s Compensation Act as modified from time to time and should indemnify the Railway from and against any claims made under the aforesaid Acts. 3. The licensee shall not be granted any free pass or season ticket in connection with the said work. 4. The Senior Divisional Commercial Manager of the Railway Administration or his authorised representatives shall have free access at all times of the said premises for the purpose of inspections/other official work. 5. The licensee shall not have any claim for any compensation in case of reduction in the users of the toilet due to any reason. 6. The licensee should not be entitled to claim against the administration for any loss, which the licensee may incur on account of fire, or any other cause. 7. The successful tenderer has to operate the contract for full term of the contract. In the event of withdrawing the contract, before completion of its full term, the Security Deposit will be forfeited. 8. The licensee is required to pay any other charges like Cess etc. on demand by the Railway Administration, as well as any other taxes due to any other authority viz., Central/State Governments, Local bodies etc., which are incidental to this licence for the period of his licence. 9. In the event of any question, dispute or difference arising under these conditions of or in connection with this licence (except as to any matters the execution of which is specially provided for these conditions) the same shall be referred to Sole Arbitrator of a Gazetted Railway Officer appointed to be Arbitrator by the General Manager, South Central Railway, Secunderabad. The Gazetted Railway Officer appointed as Arbitrator, however will not be one of those who had opportunity to deal with matters to which the licence relates or who in the course of his duties as Railway Servant has expressed views on all or any of the matters under dispute or difference. The award of the Arbitrator shall be final and binding on the parties to the contract. No person other than a person appointed by the General Manager, South Central Railway, Secunderabad shall act as Arbitrator and if for any reason that is not possible the matter is not be referred to Arbitrator at all. Subject to the provisions of the aforesaid Arbitration and Conciliation Act-1996 and the rules there under and any statutory modification thereof shall apply for arbitration proceedings under this Clause.
