About the above incident.  He has demanded and taken illegal gratification of Rs.3500/- from the accused involved in Cr.No.19/2009 u/s.154 of the Railways Act of 1989 of NLR Post, Sri.Dasaradharamaiah, near the railway court premises of NLR Rly.Court with a promise that he would be spared from appearing as accussed in the ‘Railways Act case’.

The Constable filed a writ petition No.11223 of 2009 in the Hon’ble Court of AP against the conduct of departmental enquiry.  While disposing the said writ petition on 03.07.2009, the Hon’ble Court had ordered to stall the deptl. Enquiry till such time he submits his defense in the Criminal case registered against him by CBI/VSKP.

On 02.07.2010, while he was nominated for train escort duty of train No.2656/2655 along with other staff of WL, he reported late for duty and also found to be in a state of intoxication.  It was made clear during roll calls about his turning up late for duty and also counseled to desist from the habit of drinking and in view continuance lapses on duty, inspite of giving opportunity to improve his working, he failed in this regard and this has resulted in entries in the Critical Incident Register.  Though he was dealt under DAR in the year 2007, 2008 and 2010, he has not shown perceptible changes in his working system.

Sri.S.Rahul, Con.431/CG-NED (presently absent) violating the code of conduct laid down to the members of the Force under rule 146.2(iii)  of RPF rules, 1987, absented duty for a period of 539 days on different occasions in the period from 16.08.2008 to 15.07.2010 as shown in the enclosures to Annexure-II in unauthorized manner without intimation to the administration.

3. Sri.S.Rahul, Con.431/CG-Ned (presently absent) indulged in an act of repeating the misconduct of unauthorized absenteeism by absenting duty in unauthorized manner for a period of 577 days on different occasions in the period from 30.06.2008 to 15.07.2010, ever after being punished for similar misconduct in the year 2008 vide this office D.O. No.37/2008 issued under Lr.No.N/XP.227/158/SR/08-09 dtd:23.06.2008 & D.O.No.38/2008 No.N/XP.227/158/SR/08-10 dtd:23.06.2008 and thereby committed breach of conduct laid down under Rule 146.2(i) of RPF Rules, 1987.

1. On 01.02.2010 during the duty hrs. of M.Premnat, HC/HX post between 12.00hrs. to 13.00 hrs. pilferage of diesel at   Oil 680 ltrs. was siphoned out.  During the check by IOC and RPF staff it was notice that number of plastic cans of 40 lts. Capacity, some filled with Diesel was noticed at Rly.Qtrs.   On 05.03.2010 in the evening hours 4 outsiders were apprehended and recovered the 680 lts. Of Diesel Oil value of Rs.28,800/- from unlawful possession of the accused and a case in Cr.No.2010 was registered.
2.  Serious misconduct and gross dereliction of duty in that he being a incharge of RPF Post/HX he was found slack in his supervision over the staff posted at the Oil siding/HX which resulted in theft of huge quantity of Diesel oil by the outsiders during duty hours of staff posted at Oil siding/HX.

V.B.Bansiode, con-018/NZB having  arrived by Devagiri express while coming to the RPF office and on seeing IPF/NZB, started abusing IPFNZB in vulgar language  in Hindi in public and followed him to the RPF post and  abused him in  vulgar language in from of the other RPF staff at the RPF post.
2) Reported for 1400-2200 hrs shift  duty on 18.09.10  in intoxicated condition during toll call. when IPF/NZB directed him to report ADMO/RH/NZB for medical check up along with two escorts, he again abused  IPF/NZB and other RPF staff in vulgar language in Hindi and went  away from the post and remained absent from duties on 18.09.2010.

He was directed to Railway Hospital/GTL for medical check-up.

T.Vijay Babu, HC/DLS/KZJ is invited to Rule 113 and 114 of the RPF Rules 1987 under which members of the Force are forbidden from bringing or attempting to bring any political or other outside influence to bear upon any superior authority to further his interest in respect of matter pertaining to his service under the Government.  If any representation is received on his behalf from any other person in respect of any matter dealt with in these proceedings, it will be presumed that Sri.T.Vijay Babu, HC/DLS/KZJ is aware of such a representation and that it has been made at his instance and action will be taken against him for violation of the said rules.
